1. Your right to erasure (GDPR & CCPA)
Under Article 17 of the EU General Data Protection Regulation (GDPR 2016/679) and the California Consumer Privacy Act (CCPA / CPRA), you have the right to erasure of your personal data — the "right to be forgotten".
This right applies:
- free of charge;
- without having to state a reason;
- at any time, including during an active subscription.
UK residents are covered by the UK GDPR. Residents of other jurisdictions (Brazil LGPD, Canada PIPEDA, etc.) may invoke their local equivalent — the procedure below applies to everyone.
2. How to delete your account
Three methods are available — pick the one that suits you best:
2.1 From the Lumyeye app (recommended)
- Open the Lumyeye app.
- Tap the Settings icon (top right).
- Tap Account.
- Tap Delete my account.
- Confirm the request. You receive an immediate on-screen confirmation.
2.2 By email
- Address: contact@lumyeye.com
- Subject: "Account deletion - GDPR Article 17" (or CCPA "Do Not Sell / Delete" for California residents).
- Include: your name, the email address linked to the account, and the device used (iPhone or Android).
- We may ask for a copy of an ID document if there is reasonable doubt about your identity (GDPR Art. 12.6).
2.3 By postal mail
Address: Lumyeye SAS, DPO - Account Deletion, 58 rue de Monceau, 75008 Paris, France.
Include your contact details, the email linked to your account, and the wording "Erasure request under GDPR Article 17 / CCPA Right to Delete".
3. What gets deleted
Upon deletion, the following is erased from our systems:
- Your email address and linked identifiers.
- Your payment history as visible on the Lumyeye side (accounting invoices remain archived — see next section).
- Your personal preferences (language, voice, shortcuts).
- Any residual photos in our buffers (these are normally already deleted immediately after each response).
- Voice conversation transcripts that may have been kept temporarily.
- Your exchanges with support, after the legal statute of limitations.
4. What we keep (legal obligations)
Some data must be kept under legal obligations that Lumyeye cannot waive. It is never used for any other purpose:
- Invoices and accounting records: 10 years (French Commercial Code, Article L.123-22 — equivalent retention applies under US Title 26 / IRS rules and GDPR Article 17.3.b "legal obligation").
- Anti-fraud logs: up to 5 years (transaction security, anti-money-laundering).
- Data needed for legal defense: until the applicable statute of limitations (GDPR Art. 17.3.e).
This data is stored in segregated archives with restricted access, and automatically purged once the legal period expires.
5. Processing times
- Deletion in the app: instantaneous for the visible effect (you are logged out immediately).
- Written confirmation: sent by email within 7 business days.
- Effective deletion from our databases: within 30 days maximum from the request (including backups).
- Deletion at technical sub-processors: within 30 days (Google Cloud, Sentry).
6. Impact on your subscription
- Auto-renewal canceled: account deletion automatically stops the tacit renewal of your subscription.
- Current paid period: you keep access until the end of the period already paid, unless you explicitly request immediate termination of access.
- Pro-rata refund: if you are still within the 14-day EU withdrawal period (Art. L.221-18 French Consumer Code) or US store window, you can request a proportional refund via the App Store or Google Play.
- Beyond 14 days: no pro-rata refund is automatically due, but a request can be filed with Apple or Google, who remain the decision-makers under their respective policies.
7. Exporting your data before deletion
Before deleting your account, you can exercise your right to data portability (GDPR Article 20) and receive a copy of your data.
- Send a request to contact@lumyeye.com, subject "Data portability".
- You receive a JSON or CSV file containing: preferences, anonymized usage history, and emails exchanged with support.
- Delivery time: 30 days maximum.
Note: since Lumyeye does not keep your photos or voice conversations beyond their processing, those items are not part of the export.
8. Quick FAQ
Can I restore my account after deletion?
No. Once deletion is effective (within 30 days), the data is permanently erased and cannot be recovered. If you wish to come back to Lumyeye, you will need to create a new account.
What if I tap "delete" by mistake?
A confirmation prompt is shown before final erasure. If the request was sent by email, you have a 48-hour window to cancel by simply replying "I cancel". After that, deletion proceeds.
How long for a potential refund?
If you are eligible for a refund, the delay depends on Apple (typically 7-10 days) or Google (3-7 days). Lumyeye SAS does not hold payments made through the stores and therefore cannot speed up these timelines.
Does Lumyeye actually keep anything?
Only what the law requires us to keep: accounting records (invoices, 10 years) and anti-fraud logs (5 years). No usage data, no photos, no personal preferences survive deletion.
What if Lumyeye doesn't respond in time?
EU residents may file a complaint with the CNIL (French Data Protection Authority), 3 place de Fontenoy, TSA 80715, 75334 Paris Cedex 07, or via www.cnil.fr. UK residents may contact the ICO (ico.org.uk). California residents may contact the California Privacy Protection Agency or the State Attorney General's office.
